Limits of Liability

  1. GSI liability is limited to failures due to normal wear and tear during the term of contract.
  2. GSI has the right to a second opinion. The contract holder may order their own second opinion, but shall be responsible for that cost.
  3. GSI will determine whether a covered item will be repaired or replaced. Except as otherwise noted in this contract, replacements will be similar features, capacity, and efficiency as the item being replaced. GSI is not responsible for matching brand, color and/or dimensions. When parts are necessary for completion of service, GSI will not be responsible for delays that may occur in obtaining the parts. Repairs and/or replacements that are subject to a manufacturer's warranty are excluded from this contract. An additional fee may be charged by the contractor to the contract holder for disposal of any system or component.
  4. When government regulations, building and/or similar code criteria require improvements and/or additional costs to service a covered roof system and/or component, including permits, the costs to meet proper code criteria shall be the sole responsibility of the contract holder, except where otherwise noted in this contract. GSI will be responsible for repairs and/or replacement of covered systems and after the proper code criteria are met, except where otherwise noted in this contract. GSI is not responsible to perform service involving hazardous or toxic materials and/or conditions of asbestos.
  5. GSI is not responsible for repairs or replacement due to misuse or abuse, lack of general maintenance or cleaning, disassembled and/or missing parts, or damage due to: fire, flood, smoke, lightning, freeze, earthquake, hail theft, storms, accidents, riots, war, vandalism, animals, pests, power failure, surges, and/or overload, soil movement, structural, changes, design deficiency, manufacturers' recall, inadequate capacity, land subsidence, slope failure, cosmetic defects, improper previous repair or installation of roof systems or components. The contract holder is responsible for providing maintenance and cleanings on covered items as specified by the manufacturer in insure continued coverage on such items(i.e., roof systems require periodic cleaning and debris removal.)
  6. GSI is not responsible for consequential or secondary damages resulting from the failure of a covered roof system and/or failure to provide timely service due to conditions beyond GSI control, including but not limited to delays in securing parts, equipment and/or labor difficulties.
  7. GSI is not responsible for providing access to repair or replace a covered roof system or components unless otherwise noted in this contract. When access provided under this contract, restoration to walls, closets, floors, ceilings, or the like, will be to a rough finish only. GSI is not responsible for the cost of modifications necessary to repair or replace a covered roof system or component, including but not limited to pipe runs, flues, ductwork, structures, electrical, or other modifications. GSI does not cover commercial roof systems or components or equipment modified for domestic use.
  8. Solar components are not covered.
  9. Common roof systems and components are not covered except for duplex, triplex, or fourplex, and unless every unit is covered by GSI If this contract is for a dwelling of 8 units or less, only the items contained within each individual unit are covered. Common roof systems and/or components are excluded. Flat roofs are also excluded.
  10. This contract is non-cancelable by GSI except for: (a) non-payment of contract fees; (b) fraud or misrepresentation of facts material to the issuance of this contract; or (c) when contract is Seller's Coverage and close of sale does not occur. If this contract is canceled, the provider of funds shall be entitled to a pro-rated refund of the paid contract fee for the unexpired term, less an administrative fee and any service costs incurred by GSI Upon renewal, this contract is non-cancelable except for non-payment of contract fees, fraud, or misrepresentation of facts. Cancellations: WA residents only: This contract shall be non-cancelable by the contract holder, except: if the contact is returned within no less than 20 days from the time this contract is mailed or within no less than 10 days of the delivery of this contact and no claim has been made, this contract is deemed void and the provider of funds will be refunded the full purchase price. If a claim has been made, any refund due may be credited to any outstanding balance of the amount and any excess shall be refunded to the provider of funds. A 10 percent penalty per month shall be added to a refund that is not paid or credited within 45 days after return of this contact to the provider. OR residents only: If contract is cancelled the homeowner shall be entitled to a pro-rated refund of the paid contract fee for the unexpired term, less a $25.00 administrative fee.
  11. GSI has the right to offer cash in lieu of repair or replacement of a covered roof system and/or component in the amount of GSI's actual cost to repair or replace such a roof system or component. Maximum compensation not to exceed $1,500.
  12. If the covered property re-sells prior to the expiration of the contract, call 1-888-474-5325 (1-888-GSI-LEAK) to transfer coverage to the new owner for the remainder of the current contract term. This contract may be continually renewed at the sole discretion of GSI, subject to applicable rates and terms.
  13. Coverage on lease options is available for the lessee only. Contract fees are due and payable to GSI upon execution of the lease. Coverage continues for 12 months from the lease date.   14. GSI is not responsible for the diagnosis, repair, removal, or remediation of mold, mildew, rot, or fungus, and/or damages resulting from the above mentioned, even when caused by, or related to the malfunction, repair, or replacement of a covered roof system or component.
